The above-mentioned applicant (“Applicant”) makes this application to ACV Capital LLC (“Lender”) for an inventory financing credit facility and gives the above information to Lender for this purpose. Applicant authorizes Lender to (i) file a financing statement against all of Applicant’s personal property prior to the approval of the credit application or the execution of a security agreement, (ii) upon Lender’s approval of a credit facility for applicant, to send purchase money notification letters to all prior UCC filers and negotiate subordination agreements with other lenders, and (iii) to obtain and investigate information concerning any statements made herein.

If approved for a credit facility, Applicant hereby authorizes Lender to use any telephone; email; cell phone; text messaging; facsimile machine; computer or other device; including, an automated system for the selection or dialing of telephone numbers, the playing of a recorded message or the transmission of a prerecorded voicemail; to send communications concerning Lender programs to the Applicant. Agreeing to the foregoing is not a condition to purchasing any property, goods or services. The Applicant has fully completed the application and attached all necessary documentation as described within the application. Neither this application nor any other loan request by the Applicant shall constitute a commitment by Lender to lend funds to the Applicant or to take any other action. The Applicant hereby certifies that all information submitted in and with this application is complete, accurate and true.

To Whom It May Concern, in both my individual capacity and capacity as a representative of the undersigned Applicant, I hereby authorize you to release to Lender for verification purposes, business and/or personal information concerning:

Banking and savings accounts of record;
Mortgage, commercial and personal loans of record;
Any other credit information deemed necessary in connection with a credit application, such as an Experian, Dun & Bradstreet, or other credit bureau reports on the undersigned.

To ACV CAPITAL: I hereby authorize you to directly obtain credit reports, and other personal information on me, from third-party service providers. I understand and agree that my personal consumer credit report may be requested in connection with that of the Applicant and, if the application is accepted, thereafter on a recurring basis to inform the terms of the loan. I have read the notices below and hereby consent to the use of electronic records and communications and understand that my consent applies to all records and communications that may be provided or made available to me during the course of my relationship with ACV Capital LLC. Upon request, I will be notified of whether or not a credit report was requested and the name and address of the agency that furnished the report. This information is for confidential use by ACV CAPITAL LLC in its evaluation of the Applicant’s request for credit. I have attached a copy of my driver’s license or other state-issued identification with a photo, which ACV Capital LLC may keep on record for the term of the loan, if the loan is approved. A photographic copy of this authorization may be deemed to be the equivalent of the original and may be used as a duplicate original.

NOTICES FROM ACV CAPITAL LLC: (1) CALIFORNIA RESIDENTS: A married applicant may apply for an individual account. (2) OHIO RESIDENTS: The Ohio laws against discrimination require that all creditors make credit equally available to all credit-worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio civil rights commission administers compliance with this law. (3) To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents. (4) You have the right and option (i) to have any notice or communication, including those required under the Equal Credit Opportunity Act, such as adverse action notices, made available on paper or in nonelectronic form, and (ii) to withdraw your consent to have the record provided in electronic form. This application will not be reviewed by ACV Capital LLC until all principals consent to the application. Principals include all individuals with greater than 20% ownership. This consent will be sent by mail to all principals once your application is complete.
